OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF CALIFORNIA, OREGON AND WASHINGTON WHO ARE 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID ELSEWHERE AND WHERE PROHIBITED OR RESTRICTED BY LAW.
Forbidden Fruit Ciderhouse, LLC (dba, 2 Towns Ciderhouse), HP2, their subsidiaries and affiliated companies (together, the “Sponsor”), will conduct the Sweepstakes substantially as described in these rules, and by participating, each participant agrees as follows:
Dates of Sweepstakes: The Sweepstakes will begin at 12:01 a.m. MST on May 27, 2019 and end at 11:59:59 p.m. MST on June 30, 2019 (the “Sweepstakes Period”).
How to Enter: There are two ways to enter this Sweepstakes. Entry Method No. 1 – Text the keywords found on the 2 Towns Ciderhouse Green Mountain Grill Sweepstakes displays at retail outlets. Text numbers may vary depending on the display. Entry Method No. 2 – Fill out a 3 X 5 card to include Name, Address, City, State, Zip Code, Phone Number, and Date of Birth and mailing it to: 2TGMG Sweepstakes, P. O. Box 40216, Phoenix, AZ 85067-0216. No more than one entry per envelope. Limit one (1) text entry per person per day during this sweepstakes period, regardless of the method of entry.
Sponsor is not responsible for technical difficulties, telephone or cell phone service disruptions or other equipment or service issues which might affect the ability of the Sponsor to notify the winner.
Sponsor assumes no responsibility for lost, late, damaged, stolen, misdirected, illegible, incomplete, incorrect, garbled or postage-due mail, entries or other Sweepstakes materials, all of which are void. Facsimiles or mechanical reproductions will not be accepted. All entries become the property of the sponsor and will not be returned.
Prizes: ONE (1) Grand Prize will be awarded: Winner will receive ONE (1) Green Mountain Daniel Boone Prime Wi-Fi Grill. ARV: $749.00. ONE (1) First Prizes will be awarded. Winner will receive a Green Mountain Davey Crockett Grill. ARV: $329.00. Total ARV of all prizes is $1078.00. ARV may vary. Any and all other expenses, including but not limited to are the sole responsibility of the winner.
Winner Determination: Winners will be determined in a random drawing on or about July 3, 2019 by an independent organization whose decisions will be final in all matters relating to this Sweepstakes. Odds of winning will be determined by the total number of eligible entries received. The winner will be notified by telephone or mail on or about July 3, 2019 and will be required to sign an affidavit of eligibility and liability release within THREE (3) calendar days of notification or prize will be forfeited and may be awarded to another winner at sponsor’s sole discretion. If winner cannot be located or does not respond to attempt to be notified within THREE (3) calendar days, prize will automatically be forfeited and an alternate winner may be selected at sponsor’s sole discretion. Except where prohibited, acceptance of prize constitutes winner’s consent to use of his/her name, likeness and biographical data for advertising and promotional purposes without additional compensation.
By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize. All costs and expenses associated with prize acceptance and use that are not specified herein are the sole responsibility of the winner. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of prize. Alcohol beverages are not part of any prize.
Eligibility, and Limitations: All mail and text entries must be received by June 30, 2019 at 11:59:59 p.m. MST. Winner(s) must be United States residents with current address and valid Driver’s License and at least 21-years old as determined by the Sponsor. Only one (1) prize per household will be allowed for the Sweepstakes. Prize is non-transferable. Neither HP2 nor the Sponsor will substitute winnings with different prizes or monetary compensation. Employees of the Sponsor, the Sweepstakes participating sponsors, retail advertising and promotional agencies, alcohol beverage suppliers, importers, wholesalers, distributors, retailers and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, cohabitation or other family extension, and any other persons residing at the same household whether or not related.
Text Message Entry Conditions: By participating in this Sweepstakes all entrants authorize Sponsor to provide their text messaging address. Information collected in connection with this Sweepstakes will be used in accordance with Sponsor’s privacy policy and these Official Rules. In the event of any discrepancy between the privacy policy and these Official Rules. Sweepstakes is intended for participation in the United States only and shall be construed only according to United States law. Entrants agree the Sweepstakes is governed by CA law. By participating in the Sweepstakes, you authorize Sponsor to communicate with you by text messaging for the duration of the Sweepstakes. In case of dispute as to identity of entrant, entry will be declared made by the authorized account holder of the cellular provider. “Authorized Account Holder” is defined as the natural person who is assigned a number by the cellular provider or as shown on the cellular provider’s records. Sponsor and its agencies are not responsible for SMS entries not received due to lost, failed delayed or interrupted connections or miscommunications, or to other electronic malfunctions, delays, or errors of any kind in the transmission or receipt of entries. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by any human or technological error that may occur in the processing of entries in this Sweepstakes. Any other attempted form of entry not specified herein is prohibited; no automatic, programmed; robotic or similar means of entry are permitted.
Publicity; Use of Personal Information: By participating, all participants and winner(s) grant the Sponsor exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, participants agree that the Sponsor may disclose personal information obtained from participants in the Sweepstakes to third parties and use such information for marketing and other purposes.
Release: By participating, each participant and winner waives any and all claims of liability against the Sponsor, HP2, its employees and agents, the Sweepstakes sponsors and their respective employees and agents (collectively, the “Release Parties”), for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize. In order to receive a prize, participants may be asked to sign an official waiver form provided by the Sponsor.
Limitations of Liability: The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software whether originating with entrant, Sponsor, or any third party; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (e) late, lost, undeliverable, misdirected, illegible, damaged, incomplete, incorrect, stolen, or postage due entries/mail; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, unless it is not possible to award another entry due to the date of discontinuance for any or all of the prizes offered herein. In the event of a discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance, and in no event will more than the stated number of prizes be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Sponsor makes no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
General Conditions: Entry in the Sweepstakes constitutes an entrant’s full and unconditional agreement to abide by and accept the terms and conditions of these Official Rules. No substitution of prize or cash equivalent except at Sponsor’s sole discretion. Cash equivalent may be less than the approximate retail value of the prize. Prize is non-transferable except at the sole discretion of the Sponsor. All federal, state and local taxes on the prize are winner’s sole responsibility. By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of prize. Written copies of these rules are available by mail with written request with a stamped, self-addressed return envelope at the P. O Box indicated above, or may be read on this www.hp2win.com website.
Taxes: Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that are not specifically provided for in the official rules. Each winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over $599 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Decisions: By participating in the Sweepstakes, participants agree to be bound by the decisions of Sponsor and Administrator personnel. The Sponsor reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Sponsor believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Sponsor’s decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor and are final.
Compliance with Law: The conduct of the Sweepstakes is governed by the applicable laws of California without respect to conflict of law doctrines. As a condition of participating in the Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, the entrant agrees that, by entering the Sweepstakes (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damaged multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. Further, entrant hereby agrees to indemnify and hold Sponsor harmless from and against any third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses, including attorney fees and court costs, arising out of any breach or alleged breach of any of the warranties and representations set forth herein.
- Winner’s List: For a list of winners, please send a self-addressed stamped envelope to 2TGMG Sweepstakes, c/o HP2, P. O. Box 40216, Phoenix, AZ 85067-0216. All requests for the winner’s list must be postmarked by July 31, 2019 and received by August 5, 2019.
